This privacy statement is made on behalf of Global Capital Assets Management Pty Ltd (ABN 44 162 730 583; AFSL number 439184). All references to “Global Capital”, “we”, “us” or “our” in this policy are references to Global Capital Assets Management Pty Ltd.

Global Capital is committed to protecting your privacy, to compliance with the Australian Privacy Principles contained in the Privacy Act 1988 (Cth) and to managing personal information in an open and transparent manner.

 

  1. Personal Information

The information we collect from you will depend on what services we provide to you and may include the following:

your name, address and contact details;
• your e-mail address;
• your tax file number;
• Bank account details; and
• Identification and verification information.

 

  1. Collection of Personal Information

Your personal information is collected and held for the purposes of fulfilling our obligations under the anti-money laundering and counter-terrorism financing laws in addition to our obligations under the Corporations Act.

Your personal information is usually collected directly, which means that we collect personal information about you from you. This may include directly collecting information from you if you attend any of our exhibitions or subscribe to any of our regular mail-outs or client functions. However, personal information about you including your IP Address may also be collected indirectly with website cookies. No attempt is made to identify individual users from this information.

 

  1. Disclosure and Use of Personal Information

We may disclose your personal information to our own advisors and service providers in connection with our activities as a fund manager, to your financial advisors if applicable, or to external parties who act on our behalf in the operation of our business or in connection with the transactions to be undertaken. Such external parties are required and committed to protecting your privacy.

We take reasonable steps to ensure that to the maximum extent reasonably possible any information sent overseas has the same level of privacy protection as we provide here in Australia.

Global Capital will not otherwise disclose your personal information without your consent, except as authorised or required by privacy laws or any other applicable legislation or law enforcement requirements. This may include disclosure to external regulators such as the Australian Securities & Investments Commission (‘ASIC’), the Australian Taxation Office (‘ATO’) and the Australian Transaction Reports & Analysis Centre (‘AUSTRAC’).

 

  1. Accessing& Correcting your Personal Information

You have a right to request access to personal information held about you by Global Capital, and to request that personal information about you be corrected. Please note that while we will not charge you a fee for your access request, we may charge you the reasonable cost of processing your request.

We will seek to provide such information within 14 days, and in the manner so requested (where reasonable to do so).

Global Capital may not always be lawfully able to give you access to all the personal information we hold about you. If this is the case, we will provide a written explanation of the reasons for our refusal, together with details of our complaints process for if you wish to challenge the decision.

 

  1. Making a Privacy Complaint

If you would like to make a complaint regarding a breach of the Australian Privacy Principles by us or one of our contractors, you must first contact us directly on 02 8090 9065. We will endeavour to resolve your complaint within 7 days or such further time period that may reasonably be required given the nature of the complaint. If you remain unsatisfied, you may then complain to the Office of the Australian Information Commissioner (OAIC) in writing at https://www.oaic.gov.au.

 

  1. Security of Personal Information

We take reasonable steps and precautions to keep personal information secure from loss, misuse, and interference, and from unauthorised access, modification or disclosure. If you use the Internet to communicate with us, you should be aware that there are inherent risks in transmitting information over the Internet. Global Capital does not have control over information while in transit over the Internet and we cannot guarantee its security.

Information obtained in our computer database is protected by fire walls and requires password access to designated personnel.

Where information is no longer required to be held or retained by Global Capital for any purpose or legal obligation, we will take all reasonable steps to destroy or de-identify the information accordingly.

Global capital and related companies maintain a policy of strict confidence concerning personal information it obtains. Our privacy policy has been developed in accordance with the national privacy principles of the commonwealth privacy act 1988 (privacy act).
We may also collect information from you if you attend any of our exhibitions or subscribe to any of our regular mail-outs or client functions.

You may request to see that such information is correct and up to date. This will be subject to any exemptions allowed under the privacy act.
If you are not allowed access to your personal information you will be informed of which exemptions under the act do not allow you this service. If global capital incurs any costs concerning access, we may charge a reasonable fee for such a service.

Global capital takes all reasonable steps to ensure the information it retains is accurate, complete and up to date. If any information we have is incorrect please contact us immediately and we will take all reasonable steps to correct it. All personal information is kept within a secure environment.
